Atlanta, GA, United States (4E) – The Georgia man who threw hot water on a gay couple while they were sleeping in an apartment was sentenced to 40 years in prison by a jury on Wednesday.
Accordingly, the gay couple suffered from severe burns that required surgery. The jury deliberated for more than an hour before finding 48-year-old Martin Blackwell guilty of the charges made against him. He has been charged with eight counts of aggravated battery and two counts of aggravated assault. The victims were identified as Anthony Gooden and Marquez Tolbert , who were attacked last February.
Blackwell initially faced up to 80 years in prison. Fulton County Superior Court Judge Henry Newkirk said in a statement that the evidence against Blackwell was overwhelming and that he was soulless and the attack was made maliciously. Newkirk continued to say that it takes a long time for a pot of water to boil and Blackwell’s voice of reason could have taken over.
Prosecutors called the attack vicious and premeditated. Tolbert testified against Blackwell and said that after pouring hot water on them, Blackwell grabbed him and said “Get out of my house with all that gay.” This all happened while Tolbert and Gooden were screaming and jumping in pain.
The defense attorney of Blackwell, Monique Walker, said in a statement that her client did not make any reckless conduct. She added, “It’s not about hate. It’s about old-school culture, old-school thinking.” She said that Blackwell felt the behavior of the young men were disrespectful. Walker said that Blackwell have been making inappropriate comments to the various members living in the apartment and did not want to hurt the gay couple but just wanted them to stop doing what they were doing.
However, the prosecutor said that the actions of Blackwell were well thought out.
Blackwell lived with his girlfriend, Kim Foster. Foster is the mother of Gooden . Gooden and Tolbert have been dating for about a month and were sleeping at the apartment where Foster, Blackwell, and her sister lived. They reportedly just worked an overnight shift when Blackwell decided to dump the boiling water on them.
Gooden spent about a month in the hospital and was placed in a medically induced coma for two weeks. Tolbert , on the other hand, spent 10 days in the hospital.
